Your Heat Pump Rights: What the Consumer Code Protects

By Home Heat Pump Guide ·
UK homeowner reviewing heat pump documentation and warranty papers representing consumer protection rights
You have more protection than you might think when buying a heat pump. Understanding your rights before you sign puts you in a much stronger position.

Buying a heat pump is a significant financial commitment — typically £8,000-14,000 before the BUS grant. You need to know what protection you have if something goes wrong. The good news: MCS-certified heat pump installations come with multiple layers of consumer protection, from the MCS Consumer Code to the Consumer Rights Act 2015. This guide explains every right you have, in plain English, so you can buy with confidence.

The MCS Consumer Code

The MCS Consumer Code is administered by the Renewable Energy Consumer Code (RECC) and sets minimum standards that all MCS-certified installers must follow. It covers every stage of the buying process.

Before You Buy

  • Clear, accurate advertising with no misleading claims about savings or performance
  • A pre-contractual information pack explaining what you are buying
  • Written quotation with detailed specifications and itemised costs
  • Clear explanation of the BUS grant and how it will be applied
  • No high-pressure sales tactics or artificially time-limited offers

During Installation

  • Installation must comply with MCS technical standards (MIS 3005 for heat pumps)
  • Work must be carried out by competent, qualified personnel
  • The installer must keep you informed of progress and any changes
  • Any additional costs must be agreed in writing before the work is carried out

After Installation

  • Full handover with explanation of how to operate the system
  • All documentation provided (MCS certificate, commissioning report, warranties)
  • Minimum 2-year insurance-backed workmanship warranty
  • Access to a complaints procedure with escalation to RECC
  • Deposit protection if the installer becomes insolvent

Your MCS certificate is one of the most important documents you will receive. Keep it safe — you may need it for warranty claims, property sales, or disputes.

Consumer Rights Act 2015

Alongside the MCS Consumer Code, you are protected by UK consumer law — specifically the Consumer Rights Act 2015. This applies whether or not the installer is MCS-certified (though you should always use MCS installers for the grant eligibility).

Under the Act, the heat pump and installation must be:

  • Of satisfactory quality — the system should work properly, be durable, and be free from defects
  • Fit for purpose — it must heat your home as described and agreed
  • As described — it must match what was specified in the quote and contract

The services element (installation work) must be:

  • Performed with reasonable care and skill — the standard expected of a competent professional
  • Completed in a reasonable time — if no time was agreed
  • At the agreed price — or a reasonable price if none was agreed

If any of these standards are not met, you have legal rights to a repair, replacement, or partial refund. For services, you can require the installer to redo the work at no additional cost, or claim a price reduction.

Your Cooling-Off Period

If you signed the heat pump contract at your home (which is common — most quotes are signed after a home survey), you have a 14-day cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

During this period, you can cancel for any reason — or no reason — and receive a full refund of any deposit paid. The installer must inform you of this right in writing at the time of the contract. If they fail to do so, the cooling-off period extends to 12 months.

If the installation begins within the 14-day period (with your express consent), you may still cancel but could be liable for the cost of work already completed.

Warranty Rights Explained

Heat pump warranties have two components that are often confused. Understanding the difference is important.

Warranty TypeWho ProvidesWhat It CoversTypical Length
Manufacturer warrantyHeat pump manufacturerDefects in the heat pump unit itself5-10 years
Workmanship warrantyInstallerQuality of installation work2+ years (MCS minimum)
Insurance-backed warrantyThird-party insurerCovers workmanship if installer goes bustMatches workmanship warranty
Consumer Rights ActUK lawSatisfactory quality, fitness for purpose6 years (claims limitation)

Important: warranty exclusions exist. Most manufacturer warranties require annual servicing to remain valid. Some exclude damage from incorrect installation (which is why installer quality matters so much). Always read the warranty terms before signing — and ask the installer to clarify anything you do not understand.

Documents You Must Receive

After a completed heat pump installation, you should receive all of the following documents. If any are missing, request them immediately — they are your evidence of a compliant installation and your proof for warranty and grant purposes.

  1. MCS installation certificate — confirms the installation meets MCS standards
  2. Commissioning certificate — confirms the system was tested and optimised
  3. Manufacturer warranty registration — your warranty with the heat pump manufacturer
  4. User manual and operating instructions — for your specific model
  5. Maintenance schedule — what servicing is needed and when
  6. Handover checklist — signed by both you and the installer, confirming demonstration of controls
  7. BUS grant confirmation — proof the grant has been applied to your installation
  8. Electrical installation certificate — Part P compliance for new electrical work
  9. F-gas certificate — if the system uses F-gas refrigerant (not required for R290 systems)
  10. Heat loss calculation — the room-by-room design document

Keep all your installation documents in a safe place. You will need them for warranty claims, annual servicing, and when selling your property.

BUS Grant Protections

The Boiler Upgrade Scheme (BUS) grant adds an additional layer of protection. The grant conditions require:

  • MCS-certified installer (which triggers Consumer Code protection)
  • Proper design and sizing to MCS standards
  • Full commissioning and handover
  • The grant payment goes directly to the installer, reducing what you pay

If the installation does not meet BUS grant conditions, Ofgem (which administers the scheme) can reclaim the grant from the installer. This provides a strong incentive for installers to do the job properly — they risk losing £7,500 if they cut corners.

Dispute Resolution Process

If things go wrong, the escalation path is:

  1. Contact your installer — put your complaint in writing (email or letter). Give them a reasonable opportunity to fix the problem (usually 14-28 days).
  2. Escalate to RECC — if the installer does not resolve the issue, contact the Renewable Energy Consumer Code at recc.org.uk. They offer free mediation and can make binding decisions.
  3. Citizens Advice — for free general advice on your consumer rights.
  4. Trading Standards — for serious cases involving fraud, misrepresentation, or safety concerns.
  5. Small Claims Court — for financial claims up to £10,000 in England and Wales (£5,000 in Scotland).

Credit Card Protection

If you pay any part of the cost (between £100 and £30,000) by credit card, you gain additional protection under Section 75 of the Consumer Credit Act 1974. This makes the credit card company jointly liable with the installer for any breach of contract or misrepresentation.

This means if your installer goes bust, refuses to fix problems, or the installation is fundamentally flawed, you can claim against the credit card company for the full amount — even if you only paid a small deposit by credit card. This is one of the strongest consumer protections available and costs you nothing to use.

What If Your Installer Goes Bust?

MCS-certified installations include insurance-backed warranty protection. This means if your installer becomes insolvent during the warranty period, a third-party insurer covers the workmanship warranty. You can still get defective work corrected by another MCS installer at no cost to you.

The manufacturer warranty on the heat pump unit itself is separate and unaffected by the installer's status — you deal directly with the manufacturer for any unit defects.

If you paid by credit card, Section 75 protection provides an additional safety net regardless of the installer's solvency.

Frequently Asked Questions

What is the MCS Consumer Code?

A set of requirements all MCS-certified installers must follow, covering pre-sale information, installation quality, handover, warranties, and complaints handling. It is administered by RECC.

What warranty am I entitled to?

A manufacturer warranty (5-10 years) on the unit, plus a minimum 2-year insurance-backed workmanship warranty from the installer under the MCS Consumer Code.

What if my installation is faulty?

Contact the installer first. If unresolved, escalate to RECC, Citizens Advice, or Trading Standards. See our complaints guide for the full process.

Can I cancel after signing?

If you signed at home, you have a 14-day cooling-off period. Cancel in writing for a full refund of any deposit.

Does the BUS grant come with extra protections?

Yes. The BUS grant requires MCS certification (triggering Consumer Code protection) and proper commissioning. Ofgem can reclaim the grant from installers who cut corners.

What documents should I receive?

MCS certificate, commissioning certificate, manufacturer warranty, user manual, maintenance schedule, handover checklist, BUS grant confirmation, electrical certificate, and heat loss calculation.

Your Rights, Your Investment

Understanding your consumer rights is as important as understanding the technology. The MCS Consumer Code, the Consumer Rights Act, and credit card protection together provide robust safeguards for heat pump buyers. Whether you are comparing costs, checking installer red flags, or exploring whether to pair your heat pump with solar panels, knowing your rights puts you in control. The BUS grant adds an extra incentive for installers to deliver quality work — because they risk losing £7,500 if they do not.
